Carry out the approved development generally in accordance with the approved DRAWINGS AND DOCUMENTS.

This approval does not imply permission to enter neighbouring properties to carry out the construction (including associated drainage and earthworks) or maintenance activities.  Permission to enter neighbouring properties must be obtained from relevant property owners.

3)   Complete All Building Work

Complete all building work associated with this development approval, including work required by any of the conditions included in the Development Approval Package. 8)   Visitor Parking

Visitor car parking spaces must:

- Be clearly labelled as 'Visitor Parking'; and

- Remain unimpeded by landscaping, water tanks, storage (temporary or otherwise), gates (except for the roller door/security gate as shown on the approved DRAWINGS AND DOCUMENTS) or any other fitting, fixture or structure to provide 24 hour unrestricted access for bona fide visitors.

The roller door/security gate and the access to visitor parking beyond as shown on the approved DRAWINGS AND DOCUMENTS must be configured to:

- Allow unrestricted access for bona fide visitors by maintaining the roller door/security gate in a permanent open position between the hours of 5am and 10pm;

- Allow bona fide visitors 24 hour unrestricted access to the visitor parking spaces between the hours of 10pm and 5am via an electronic access control system;

- The electronic access control system is to be clearly located in a position which can be easily and efficiently accessed while the vehicle is standing.

Submit for the approval of Development Assessment architectural drawings prepared and certified by a Registered Architect showing the final developed details of the façade treatment, the ground interface and the roof top/building capping elements which depict a higher level of documentation detail than that shown on the APPROVED DRAWINGS AND DOCUMENTS, including:

  Elevation and façade treatment drawings for all ground, podium and typical tower floor levels that demonstrate the final design outcome for all elevations of the built form including:  

    - Detailed plans, sections and elevations at 1:50 or 1:20 scale for elements at the façade including structural elements and fixed and operable elements such as balustrades, screens, doors, windows, projecting fins and planter beds/trellises

    - All servicing and infrastructure, including but not limited to, padmount transformers, pump rooms, fire hydrant boosters etc.

    - Roof top or building capping elements, awnings and soffits

    - One rendered perspective showing the intended finished built form

The architectural drawings must:

  - include dimensions for  the extent of projecting elements, balustrade height and door and window/glazing configurations

  - nominate materials, colours and finishes

  - have title blocks and be cross referenced to larger scaled drawings.

All Multiple Dwellings units must be setback at least 10 metres from the kerb (minimum separation distance as specified in the Transport Air Quality Corridor Overlay Code) of Samford Road, or alternatively, any Multiple Dwellings units located within the 10 metres must be installed with ducted mechanical ventilation for the supply of outdoor air in compliance with AS 1668.2-2002: The use of ventilation and air conditioning in the buildings, and:

(i) locates the mechanical ventilation outdoor air intakes at least 10 metres from the kerb (measured in the horizontal and vertical planes as specified in Transport Air Quality Corridor Overlay Code); or

(ii) include filtration of outdoor air to a minimum performance standard of F6 or minimum efficiency reporting value (MERV) 9, and then to be maintained.

For Multiple Dwelling units located within 10m from the kerb as mentioned above, install ducted mechanical ventilation as per AO1(b) of the Transport Air Quality Corridor Overlay Code of Brisbane City Plan 2014, for the supply of outdoor air in compliance with AS 1668.2: The use of ventilation and air conditioning in the buildings, and:

(i) locate the mechanical ventilation outdoor air intakes at least the minimum distance, measured in the horizontal and vertical planes (refer to Figure b), from the kerb as specified in Table 8.2.23.3.B of the Transport Air Quality Corridor Overlay Code of Brisbane City Plan 2014; or

(ii) include filtration of outdoor air to a minimum performance standard of F6 or minimum efficiency reporting value (MERV) 9, and then to be maintained.

26(a) Submit Engineering Drawings

Submit for the approval of Development Assessment engineering drawings prepared and certified by a Registered Professional Engineer Queensland in accordance with the relevant Brisbane Planning Scheme detailing the design of the proposed excavation as well as proposed temporary and permanent support (if no temporary proposed) systems.

The design must include at least the following:

- The location (in plan and section) of the proposed excavation;

- detailed design of proposed temporary support of the excavation;

- if no temporary support is proposed then detail design of the proposed permanent support of the excavation;

- any retention system, including associated drainage, is to be wholly contained within the site unless written approval has been obtained from the affected neighbouring property owner;

-The existing and proposed finished levels in reference to the Australian Height Datum (including cross-sections or long sections into the adjacent properties);

- Preservation of all drainage structures from the effects of structural loading generated by the excavation;

-Protection of adjoining properties and roads from ponding or nuisance from stormwater;

- all existing Brisbane City Council stormwater lines and Maintenance Holes, including depths of Maintenance Holes and clearances to retention structures is to be shown.

Where ground or rock anchors are proposed as a temporary support (Note: permanent anchors are not acceptable) the design is to include the following in addition to the above:

-  their position and length (in elevation view and sectional view);

- where the anchoring system is proposed to encroach into a neighbouring property written approval is to be obtained from the affected property owner;

- Plans must show the location of the ground anchors in relation to all existing services and public utilities. The cost of relocating any existing services, public utilities or BCC assets is the responsibility of the Developer;

Where any ground anchors or rock bolts are proposed within 10metres in the vertical plane of a QUU sewer, QUU water main, BCC stormwater line or combined sanitary drain assessment will be required against the QDC section MP1.4 by the building certifier.

b) The sign is to list the name, postal and/or email address and a contact telephone number for the following parties (where relevant) that are undertaking work on the site:

     Developer;
     Project Coordinator;
     Architect/Building Designer;
     Builder;
     Civil Engineer;
     Civil Contractor/s; and
     Landscape Architect;

c) The lettering on the sign is to be at least 25 millimetres in height, be of regular weight and in sentence case;
d) The sign is to be a minimum size of 1,200 millimetres by 900 millimetres;
e) The maximum area of the sign is to be 2.0m2;
f) The sign is to be positioned as follows:

     located centrally along each road frontage of the site to Lorne Street and Samford Road;
     located on or within 1.5 metres of the road frontage;
     mounted at least 300 millimetres above ground level; and
     clearly visible from the street for a pedestrian;

g) The sign is to contain no commercial or corporate advertising other than the name, logo or slogan of the parties outlined in part (b) of this condition;
h) The sign is to be non- illuminated; and
i) Both the sign and the supporting structure are to be made of weatherproof material and to be properly maintained at all times;

28)   Retaining Walls

Design and construct all retaining walls and associated fences, in accordance with the relevant Brisbane Planning Scheme Codes and including the following:

- All retaining walls including the footings, must be located wholly within the property boundary of the site where works are occurring
- Retaining walls to stabilise excavation must be set back off property boundaries to accommodate subsoil drainage without encroachment into the neighbouring property. This set back may vary depending on the height, structure and design of the retaining wall, including loadings from neighbouring properties, and to provide a surface drain along the top of the retaining wall
- Retaining walls that are greater than 1.0m in height must be vertically and horizontally tiered by a ratio of 1:1 unless an alternative has been approved by Development Assessment
- Runoff from surface drains and subsoil drainage associated with the retaining wall must be collected and conveyed to a lawful point of discharge and must not cause any ponding, nuisance or disturbance to adjacent property owners
- Retaining walls in excess of 1.0m in height must be designed and certified by a Registered Professional Engineer Queensland
- Retaining walls facing onto Council property (including the road reserve and parkland) must not be constructed from timber.

(viii) Employee and visitor parking areas;
(ix) Anticipated staging, programming;
(x) Provision for fire exit routes for other uses on the subject or adjoining sites;
(xi) Notify development Assessment of construction considered necessary to be conducted out of normal business hours (where normal hours are defined as Monday to Saturday between 6:30am and 6:30pm excluding public holidays).
(xii) The details identified in (xi) above must be accompanied by a consultation strategy for seeking, recording and addressing the impacts of the work on the affected community

Notes:
- Approval for footpath closures and/or temporary vehicle access will only be considered where it can be demonstrated that no other reasonable alternative can be provided due to site constraints and that safety, capacity and/or operation of public transport, vehicle and pedestrian traffic are not compromised.
- Proposed arrangements utilising any part of the road reserve for construction related activities, for example, on-street work zones, overhead gantries, or where paid parking spaces are impacted upon or pedestrian diversions proposed are subject to separate application fees and rental fees.

iii. Provide 51 x secure residential bicycle parking spaces and 13 x visitor bicycle spaces

(ii) The driveway into a basement must be designed and constructed to minimise local driveway stormwater runoff entering the basement. The drainage must be designed to capture runoff from a 10% AEP rainfall event and gravity drain to a lawful point of discharge.

(iii) Vehicle access into any basement from a Council road will require the basement driveway to ramp up a minimum of 200mm, above adjacent road channel invert, to maintain road major flow capacity.

47)   Buildings in Transport Noise Corridors - Acoustic Treatments (State Roads)

All new houses, townhouses, units, hotels and motels (Class 1-4 buildings) on sites located in a designated transport noise corridor are required to comply with the requirements of the Queensland Development Code Mandatory Part 4.4 - Buildings in Transport Noise Corridors. The buildings will need to achieve specific levels of noise mitigation through the use of appropriate materials for floors, walls, roofs, windows and doors for the relevant noise category.

48)   In Principle support for street tree interference or removal

As street trees are protected vegetation, the interference with or removal of these trees requires a permit under the Natural Assets Local Law (NALL), issued by Program Planning and Integration (PPI). Development Services has sought preliminary advice from PPI regarding the identified removal/interference with existing street tree/s.

Removal of 1x Xanthostemon chrysanthus - Golden Penda identified on the approved plans fronting Lorne Street is supported in principle for this development at this time. However, a separate NALL permit is required.

Detailed arrangements must be made with PPI in relation to the works carried out on protected vegetation (including provision for tree removal and replacement tree planning costs as determined by the Arboriculture Team) prior to carrying out any works on protected vegetation. PPI Arboriculture Team can be contacted via BI-CS-PPI-PLANNING- ARB@brisbane.qld.gov.au.

Note: All requirements of development approval conditions with timing stipulated as 'prior to site works commencing' (or equivalent) must be fulfilled before Council can issue a NALL permit.

Provision must be made for equitable access for persons with disabilities to and within the site in accordance with the Queensland Anti- Discrimination Act 1991, the Federal Disability Discrimination Act 1992 and Australian Standard AS1428 Parts 1-4, Australian Standard for Access and Mobility and the National Construction Code.

51)   Water and Wastewater

Services for water and wastewater (sewerage) are no longer under the jurisdiction of Brisbane City Council. Authorisation to connect the approved development to the water/wastewater networks and for property service connections requires a Water Approval under the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009. Any necessary Water Approval must be obtained from the relevant distributor- retailer (currently operating as Queensland Urban Utilities for the Brisbane City Council area).

For the purpose of compliance assessment of a subdivision plan pursuant to Schedule 19 of the Sustainable Planning Regulation 2009 (whether in relation to a development permit for Reconfiguring a Lot or a Building Format Plan subsequent to a development permit for a Material Change of Use), documentary evidence, issued by the relevant distributor-retailer, must be provided to Council to verify that the conditions of any necessary Water Approval under the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009, have been complied with.
