2)   COPY OF PLANS ON SITE

A legible copy of the approved drawings and documents bearing "Council Approval" and the Development Approval Conditions package is to be available on site at all times during construction and earthworks.

The copy of the conditions and plans should be located in any site management office or with the site foreman. 3)   CARRY OUT THE APPROVED DEVELOPMENT

Carry out the approved development generally in accordance with the approved drawing(s) and/or document(s).

GUIDELINE
This condition refers to the approved plans, drawings and documents to which the approval relates and is the primary means of defining the extent of the approval. Approved plans, drawings and documents are stamped PLANS and DOCUMENTS referred to in the APPROVAL and are dated to reflect the date of approval of the application by Council's Delegate.

4)   COMPLETE ALL BUILDING WORK

Complete all building work associated with this development approval, including work required by any of the following conditions. Such building work is to be carried out generally in accordance with the approved plans, drawing(s), and/or documents and, where the building work is assessable development, in accordance with a current development permit.

GUIDELINE
This condition is imposed to ensure all building work associated with the use are in place before the use commences. It is not appropriate that the site be used without such work being completed. Please note that the work referred to in this condition involves operational work and may therefore constitute 'assessable development'. The Council informs you there fore that this condition does not authorise assessable development to occur and a development permit may therefore be necessary. Please refer to the Council's information sheets. For any enquiries about this condition, please contact the Assessment Manager.

5)   MAINTAIN THE APPROVED DEVELOPMENT

Maintain the approved development (including landscaping, parking, driveways and other external spaces) in accordance with the approved drawing(s) and/or documents, and any relevant Council engineering or other approval required by the conditions.

GUIDELINE
This condition restricts changes that can be made to the approved development. Approved plans and documents are stamped PLANS and DOCUMENTS referred to in the APPROVAL and are dated to reflect the date of determination of the application by the Council's delegate. The extent to which plans can be modified is constrained by the definition of 'minor change' in schedule 10 and the requirements of section 3.5.24 of the "Integrated Planning Act 1997". 6)   FENCING
Any proposed fencing on the boundaries of the subject site must comply with the following:

Unless an alternative design for the fence is agreed to with the owners of adjoining land, erect a 1.8m high screen fence along the northern, southern and western boundaries of the site.

GUIDELINE
This condition has been imposed in order to ensure that: a). Fencing forward of the building line enables casual surveillance of the street from the development and assists in highlighting entrances to the development; and b). Fencing behind the building line does not unreasonably impact on the amenity of adjoining properties.

9)   SEWERAGE: PER ET (EQUIVALENT TENEMENT)

Pay to Council a monetary contribution towards the cost of sewerage headworks, as outlined below, at the rate prevailing when the contribution is paid.

 

The contribution is calculated on 45 ETs (Equivalent Tenement) at the current rate of $3,304.00 per ET, for Sewerage Scheme Charge Area - S5, CDNEO2.

 

The amount payable is currently assessed at $148,680.00 and comprises of the following :

• Treatment Headworks component: $37,125.00
• System Headworks component: $111,555.00
• Total contribution: $148,680.00

This headwork charge is the current rate for the 2005/2006 financial year.

 

 

 

GUIDELINE

All balconies and terraces shown on the approved drawings and documents, are to remain unenclosed with no shutters, glazing, louvres or similar permanent fixtures other than those consistent with the relevant "Brisbane City Plan 2000 - Residenetial Code" and clearly depicted on the approved drawings.

15)   REHABILITATION
Rehabilitate the site in accordance with an approved Rehabilitation Plan.

Submit a Rehabilitation Plan and obtain approval from the Delegate, Development Assessment. The Rehabilitation Plan is to be in the form of scaled plans and supporting documentation that includes at least the following information for the Covenant Areas A and B on proposed lot 1, identified on Drawing No. "Habitare _291105/1, as amended in RED":

  • Description of proposed rehabilitation, including earthworks, methods, objectives, to maintain and improve the habitat and corridor values of the covenant area (e.g. planting of canopy species in existing gaps to enhance glider movement functions);
  • Details of the proposed rehabilitation schedule, including staging, plant species names, stock size, quantities, locations;
  • A maintenance and monitoring program for all rehabilitation works;
  • Stabilisation methods for all areas of exposed soil surface;
  • Details of special habitat features to be provided for the enhancement/restoration of habitat values;
  • Weed management measures; and
  • Specification notes on planting methods, mulching and soil preparation.

 

 

 

GUIDELINE
This condition is imposed when the proposed development includes areas to be rehabilitated. It is expected that rehabilitation works will be carried out to a high standard and maintained accordingly. The requirements of this condition may be included as part of an Environment Management Plan (EMP) OR Vegetation Management Plan (VMP).   • Fences are to be constructed in a manner which permits passive surveillance of parkland. Fences are to be at least 90 % transparent. Suitable materials may include chainmesh, weldmesh or pool style fencing.
  • The Fence is to be maintained in this location.

This condition is imposed to protect native fauna and to allow passive surveillance of parkland and covenant areas.

17)   STORMWATER QUALITY (HIGH RISK) MANAGEMENT PLAN
Prepare a Site Based Stormwater Quality Management Plan.

Submit and receive approval from the Delegate, Development Assessment for a Site Based Stormwater Quality Management Plan. The plan must be prepared by a suitably qualified and experienced professional and be in accordance with Council’s Subdivision and Development Guidelines (2000 or later version).

GUIDELINE
This condition is imposed to ensure that adequate measures are adopted to prevent stormwater quality being affected as a result of the construction and operational stages of the development. It is applied where compliance with Council's Water Quality Objectives must be demonstrated as part of an Operational Works application. Site Based Stormwater Management Plans (that address short and long term stormwater management from a quality and quantity perspective, and provide details of the measures to be adopted to prevent or minimise the contamination of stormwater and the release of contaminated stormwater from the site. Implement and maintain the approved Site Based Stormwater Quality Management Plan to prevent or minimise the contamination of stormwater and the release of contaminated stormwater.

18)   SELF CERTIFICATION
Design and implement landscaping in accordance with the relevant City Plan Codes and best trade practice.

Design and document a detailed Landscape Plan, and implement, in accordance with the approved Tree Retention Plan, The Site Based Stormwater Management Plan, the City Plan, Australian Standards and best trade practice. The following issues are to be addressed during this process:

  • Crossovers within the road reserve are to be constructed to Council standards;
  • Provide trees and shrubs within the recessess or landscape strip associated with the Acoustic fence along Norris Road;
  • Protection of existing trees on site as shown on the approved plans of layout. Any trimming of these trees is to be carried out by a qualified arborist in accordance with the relevant Australian Standards;
  • WSUD devices are to be located within the road reserve and not on private property;
  • Street trees are to be selected from Council's "street tree list" and planted with the approval of the Street Tree Co-ordinator Vegetation and Pest Services. Phone 3403 8888 to arrange an inspection prior to locating the trees on site;
  • Estate Signage is not to be located within the road reserve.

 

GUIDELINE
This condition is imposed when a Landscape Concept Plan has been prepared and approved as part of the High Level approval package. Compliance Certificate (Form # CC2057) is available from any of the Regional Business Centres or the Brisbane Administration Centre, or contact the Landscape Architect, Development Assessment.

18(a) SELF CERTIFICATION

On completion provide written confirmation to the Landscape Architect, Development Assessment (in the form of a completed Compliance Certificate - Landscaping) from:

  • an experienced and qualified landscape architect/designer that the detailed design drawings meet Council requirements and are generally in accordance with the approved Landscape Concept Plan; and
  • a licensed and experienced Landscape Contractor that the completed landscaping complies with the detailed design specifications and relevant Council Standards, Australian Standards and best trade practice.

Submit a copy of the as-constructed design drawings and maintenance specifications with the completed Compliance Certificate-Landscaping.

19)   ROAD NOISE SOUND LEVELS FOR RES. DWELLINGS
Design, construct and certify all proposed residential units affected by road traffic in accordance with the recommended design sound levels as specified below:

Design all proposed residential dwellings affected by road traffic to achieve the relevant maximum recommended design sound levels specified in Australian Standard AS2107 "Acoustics - Recommended Design Sound Levels and Reverberation Times for Building Interiors" using the methods set out in Australian Standard AS3671- "Acoustics - Road Traffic Noise Intrusion Building Siting and Construction".

GUIDELINE
This condition is imposed where the achievement of acceptable noise levels is dependent on noise attenuation measures being implemented in the design and construction of the development.

19(a) ROAD NOISE SOUND LEVELS FOR RES. DWELLINGS

Construct all proposed residential dwellings affected by road traffic in accordance with the approved design that achieves the relevant maximum recommended design sound levels specified in Australian Standard AS2107 "Acoustics - Recommended Design Sound Levels and Reverberation Times for Building Interiors" using the methods set out in Australian Standard AS3671- "Acoustics - Road Traffic Noise Intrusion Building Siting and Construction".

19(b) ROAD NOISE SOUND LEVELS FOR RES. DWELLINGS

Submit to the Delegate, Licensing and Compliance, Development and Regulatory Services, certification from an independent and appropriately qualified acoustic consultant which demonstrates that the necessary acoustic treatments referred to in the acoustic consultant's report prepared by Vipac Engineers & Scientists Ltd, Ref no. 746637_TRP_003851__00 and dated 28th June 2005 and the supplementary comments provided by VIPAC dated 13th February 2006 in relation to the approved amended plan (Plan Ref; 291105/1), have been incorporated into the building envelope of the proposed dwellings to achieve the relevant maximum recommended design sound level specified in the above Australian Standard.

20)   AIR CONDITIONING TO NOISE AFFECTED DWELLINGS

Air conditioning must be provided to dwelling no's.8, 9, 17, 38-47.

21)   ACOUSTIC BARRIER

Erect a 2.2 m high acoustic barrier on the Eastern property boundary along the Norris Road. The acoustic barrier must:

  • be returned by not less than 1.2 m at each end;
  • be constructed of a material with a minimum surface area density of 12 kg/m2;
  • be constructed of an aesthetically pleasing weather resistant material such as earth, fibre cement, timber or brick;
  • be otherwise continuous, straight and gap free and
  • be located 500mm within the property boundary and with planting being provided within the setback which will obscure the fence within 2 years of planting. The planting is to be maintained by the landowner.

 

GUIDELINE
This is imposed where an acoustic barrier is required to ensure the sensitive receptors are not subject to excessive noise.

22)   ON-SITE EROSION
Minimise on-site erosion and the release of sediment or sediment-laden stormwater from the site at all times through compliance with an approved Erosion and Sediment Control (ESC) Program for the site.

Submit an Erosion and Sediment Control (ESC) Program which complies with Council's Erosion and Sediment Control Standard (Version 9 or later), and receive approval from the Engineering Delegate, Development Assessment, prior to the commencement of land-disturbing activities;

GUIDELINE
This condition is imposed where the land-disturbing development (as defined in the current version of Council's Erosion and Sediment Control Standard) involves site works that could lead to significant erosion and loss of sediment from the site. The ESC Program must be prepared in accordance with Councils Erosion and Sediment Control Standard (Version 9 or later), and may include detailed plans, descriptions of control measures, monitoring programs and maintenance procedures. Please note that the work referred to in this condition involves operational work and therefore requires an operational works application to be submitted. Relevant guidelines to assist in the preparation of ESC Programs include the: "Soil Erosion and Sediment Control - Engineering Guidelines for Queensland Construction Sites" The Institute of Engineers, Australia (Qld), 1996 (or later version); "Sediment Basin Design Guidelines", Brisbane City Council, February 2000 (or later version); and "Best Practice Guidelines for the Control of Stormwater Pollution from Building Sites" and accompanying fact sheets, Brisbane City Council and Gold Coast City Council, 2000 (or later version). NB. The ESC Program may form part of a Site Based Stormwater Management Plan (that addresses short and long-term stormwater management from a quality and quantity perspective) or an Environmental Management Plan (EMP). For any enquiries about this condition, please contact the Engineering Delegate, Development and Regulatory Services.

22(a) ON-SITE EROSION

Implement and modify as necessary the approved ESC Program to maintain compliance with the Erosion and Sediment Control Standard (Version 9 or later) at all times during the period from when land-disturbing activities begin to when responsibility for the site no longer lies with the applicant.

23)   SERVICES FOR RECONFIGURATION

The applicant(s) is to acknowledge in writing that at the time of reconfiguration, each allottment will require a seperate sewer, water, electricity and phone connection prior to the endorsement of the survey plan.

GUIDELINE
This condition is imposed to ensure the applicant is aware that even though separate services are not conditioned as part of the Material Change of Use, separate services will be conditioned under any reconfiguration approval to create freehold title allotments. The design of the footpath works is to include any permanent safety signs, markings and devices (if required).

GUIDELINE
This condition requires works to be undertaken in the road reserve. The intention of the condition is to ensure that the adjoining footpaths are designed and constructed to a standard suited to the demands created by the approved development. This condition is imposed to ensure that adequate measures are adopted to prevent stormwater quality being affected as a result of the construction and operational stages of the development. It is applied where compliance with Council's Water Quality Objectives must be demonstrated as part of an Operational Works application. Site Based Stormwater Management Plans (that address short and long term stormwater management from a quality and quantity perspective, and provide details of the measures to be adopted to prevent or minimise the contamination of stormwater and the release of contaminated stormwater from the site.   • Crossovers within the road reserve are to be constructed to Council standards;
  • Provide trees and shrubs within the recessess or landscape strip associated with the Acoustic fence along Norris Road;
  • Protection of existing trees on site as shown on the approved plans of layout. Any trimming of these trees is to be carried out by a qualified arborist in accordance with the relevant Australian Standards;
  • WSUD devices are to be located within the road reserve and not on private property;
  • Street trees are to be selected from Council's "street tree list" and planted with the approval of the Street Tree Co-ordinator Vegetation and Pest Services. Phone 3403 8888 to arrange an inspection prior to locating the trees on site;
  • Estate Signage is not to be located within the road reserve.

 

GUIDELINE
This condition is imposed when a Landscape Concept Plan has been prepared and approved as part of the High Level approval package. GUIDELINE
This condition is imposed where the land-disturbing development (as defined in the current version of Council's Erosion and Sediment Control Standard) involves site works that could lead to significant erosion and loss of sediment from the site. The ESC Program must be prepared in accordance with Councils Erosion and Sediment Control Standard (Version 9 or later), and may include detailed plans, descriptions of control measures, monitoring programs and maintenance procedures. Please note that the work referred to in this condition involves operational work and therefore requires an operational works application to be submitted. Relevant guidelines to assist in the preparation of ESC Programs include the: "Soil Erosion and Sediment Control - Engineering Guidelines for Queensland Construction Sites" The Institute of Engineers, Australia (Qld), 1996 (or later version); "Sediment Basin Design Guidelines", Brisbane City Council, February 2000 (or later version); and "Best Practice Guidelines for the Control of Stormwater Pollution from Building Sites" and accompanying fact sheets, Brisbane City Council and Gold Coast City Council, 2000 (or later version). NB. The ESC Program may form part of a Site Based Stormwater Management Plan (that addresses short and long-term stormwater management from a quality and quantity perspective) or an Environmental Management Plan (EMP). Rehabilitate the site in accordance with an approved Rehabilitation Plan.

Submit a Rehabilitation Plan and obtain approval from the Delegate, Development Assessment. The Rehabilitation Plan is to be in the form of scaled plans and supporting documentation that includes at least the following information for the Park area identified on Drawing No. "Habitare_291105/1, as amended in RED":

  • Description of proposed rehabilitation, including earthworks, methods, objectives, to maintain and improve the habitat and corridor values of the covenant area (e.g. planting of canopy species in existing gaps to enhance glider movement functions);
  • Details of the proposed rehabilitation schedule, including staging, plant species names, stock size, quantities, locations;
  • a maintenance and monitoring program for all rehabilitation works;
  • Stabilisation methods for all areas of exposed soil surface;
  • site remediation work including removal of barbed wire, building materials, rubbish, debris, uncontrolled fill and other obstacles which may present a public liability risk;
  • Provide habitat features for the enhancement/restoration of Squirrel Glider habitat including nesting boxes to facilitate connectivity to adjoining habitat areas;
  • Provide a weed management strategy including identification of declared weeds, bushland weeds strategies for removal or control and links with staging for rehabilitation works;
  • Specification notes on planting methods, mulching and soil preparation;
  • Construction of vehicular barriers/bollards along park frontages to prevent unauthorised vehicular access to the park and provision of a lock-rail access point for maintenance vehicles to road frontage;
  • Details of a maintenance program, including the costing of all works and details of a 12 -month maintenance plan for all proposed landscaping & rehabilitation works, including replacement of failed works, weed management staging of works, methods of establishment and projected ongoing maintenance costs.

This condition is imposed when the proposed development includes areas to be rehabilitated. It is expected that rehabilitation works will be carried out to a high standard and maintained accordingly. The requirements of this condition may be included as part of an Environment Management Plan (EMP) OR Vegetation Management Plan (VMP). Submit a Vegetation Management Plan (VMP) and obtain approval from the Delegate, Development Assessment. TheVMP is to be in the form of scaled plans and supporting documentation that includes at least the following information:

  • The extent of the VMP is to include evaluation of all areas including, proposed road reserves, external works and development areas;
  • The location and description of existing vegetation including species and botanical name plus the height and canopy spread;
  • The location and extent of all site works including all proposed infrastructure and areas of earthworks. With the exception of sewer, no infrastructure ( water, stormwater, gas, electricity, telecommunications etc) is to be located within the Covenant Areas A and B on proposed lot 1 and the area to be dedicated as parkland. The sewer alignment from proposed Lot 31 to the existing manhole in the south west corner of 211 Norris Road is to be determined at Operational Works stage in consultation with the North Team Ecologist, and tunnel boring of sewer will be required to ensure retention of vegetation.
  • Detail design of all civil works is to be cognisant of environmental values. Alternative solutions may be required in some instances, to protect significant vegetation (eg alternative service alignments, variations to batter slopes and tunnel boring);
  • The location and description of all vegetation to be retained and that to be removed;
  • A description of all measures to be used to protect vegetation and habitat features to be retained during construction. Specifically, temporary protective fencing must be erected along the boundary of the Covenant Area A on Lot 2 and the area to be dedicated as parkland, to protect trees in these areas from damage from site works. Protective fencing must be located at the drip-line of the trees and must be left in place throughout the duration of the construction phase of the development;
  • A description of all pruning and tree surgery works (to AS 4373/96) to maintain health and stability of trees and reduce potential hazards for future residents;
  • The location and extent of storage and stockpile areas for cleared vegetation and site mulch;
  • A description of all methods to salvage and/or re-use cleared vegetation. Generally cleared vegetation is to be mulched for reuse in landscape/rehabilitation works; and
  • Details of all measures to protect and recover fauna during clearing operations, including; presence of a qualified wildlife officer during clearing operations, preclearing inspections, staging and sequence of clearing and recovery procedures.

Where animals are in trees they shall be allowed to move on naturally and work shall cease on that tree until the animal has moved on.

The ESC Program must be prepared in accordance with Councils Erosion and Sediment Control Standard (Version 9 or later), and may include detailed plans, descriptions of control measures, monitoring programs and maintenance procedures. Please note that the work referred to in this condition involves operational work and therefore requires an operational works application to be submitted. 80)   RETAINING WALLS

Any retaining walls greater than 1.0 metre in height are required to be structurally certified for design and construction by a Registered Professional Engineer Queensland (RPEQ). The certification is to include the stormwater drainage (surface and seepage water) associated with the wall ensuring that the water is directed to an acceptable lawful and legal point of discharge and does not cause any ponding, nuisance or disturbance to adjacent property owners. All retaining walls are to comply with the City Plan Filling and Excavation Code.

GUIDELINE
This condition is intended to ensure that retaining walls associated with the development that are higher than 1 metre, are designed and constructed to industry standards and also, to ensure that no adverse impact is created by the structures on the surrounding properties. The retaining wall designer should note that timber retaining walls facing onto Council property (including the road reserve) will not be permitted. Retaining walls facing onto road reserve or parkland are to be contained entirely within the proposed development site, including the retaining wall's footings. Where retaining walls are proposed to be constructed between adjoining properties, it is also suggested that the use of timber sleeper retaining walls be restricted due to their limited life and the potential problems they may cause to future property owners. Where the combined height of the retaining wall and fence exceeds 2.0 metres, a Development Permit for Building Work will need to be granted. This condition is imposed where it is necessary to obtain a lawful point of discharge for a drainage outlet and/or authority to pipe across adjacent properties to the lawful point of discharge. The detailed design application seeking engineering approval in respect of this work should show the drainage outlet and/or the drainage across adjacent properties to the lawful point of discharge. Works necessitated by this condition must be carried out in accordance with the relevant detailed design approval. 96)   SERVICE CONDUITS & MAINS
Supply and install all service conduits and meet the cost of any alterations to public utility mains, existing mains, services or installations required in connection with the approved development (This includes the provision of all services and/or conduits along the full length of any rear allotment access or access easement). It should be noted that this condition includes the relocation of any fire hydrant and/or valves from within the limits of the development's vehicular footway crossings if applicable.

Complete the works required by this condition;

GUIDELINE
This condition is imposed when additions, alterations or extensions to service conduits, mains and other services are required as a result of the approved development. Applicants should liaise with the appropriate service authorities. Typical underground service conduiting to be constructed includes, power, phone, telecommunications, sewer, stormwater and gas if applicable. For any enquiries about this condition, please contact the Engineering Delegate, Development and Regulatory Services (regarding advise on traffic signal conduits, stormwater, water supply and sewerage mains etc.) or the relevant public utility authorities (for advice on other services).

97)   CONSTRUCT WATER MAIN FROM A TO B
Construct a 150 mm diameter water main along the proposed new road to provide for the future development of the site and the northern properties in accordance with Council's "Water and Sewerage Reticulation Standards" (except for the connection to the water main).

Submit engineering plans prepared by a Registered Professional Engineer Queensland (RPEQ), and in accordance with Council's "Water and Sewerage Reticulation Standards" showing the design of the works. Obtain approval from the Engineering Delegate, Development Assessment, Development and Regulatory Services;

GUIDELINE
This condition is imposed when augmentation or extension of the water main is required to bring an adequate water supply to the site. For any enquiries about this condition please contact the Engineering Delegate, Development and Regulatory Services.

Submit "As Constructed" plans including an assest register, approved by a Registered Professional Engineer Queensland (RPEQ) (to a standard specified in Council's "Water and Sewerage Reticulation Standards") certifying that the works have been completed in accordance with the approved design and any approved modifications.
